South India

An FIR has been registered against Congress interim President Sonia Gandhi in Sagar taluk of Shivamogga district of Karnataka over tweets about PM-CARES fund.

KV Praveen Kumar, an advocate by profession, has registered a case against Gandhi at the Sagara New Town Police station in the district.

The FIR, registered under Sections 153 (want only giving provocation with intent to cause riot) and 505 (statements conducing to public mischief) of the Indian Penal Code (IPC), identifies Gandhi as the handler of the social media account.

The complainant has alleged that the Congress party had on May 11, 2020, made false and baseless allegations, claimed misappropriation of PM-CARES Fund and cast aspersions on the Government of India through the tweets.

Praveen alleged that the Congress party, through the tweets, has made rumourous statements against the Government of India and Prime Minister Narendra Modi and was trying to provoke the people against the government.

On May 11, in a series of six tweets, the party targeted the PM Cares Fund through graphs and pictures, which questioned Prime Minister Narendra Modi on the purpose and location on the money thus collected.

“The tweets were made from the party's official twitter handle and it also has the picture of Sonia Gandhi, hence for any communication that is uploaded or put on this page, she is solely responsible. Hence she is named in the FIR," Praveen said.

The Prime Minister's Citizen Assistance and Relief in Emergency Situations Fund ( PM Cares Fund) was created on 28 March 2020, following the COVID-19 pandemic in India.

The fund will be used for combating, containment and relief efforts against the coronavirus outbreak and similar pandemic like situations in the future.
