Madras HC allows individuals to install, immerse Ganesha idols in TN; no permission to groups to organise celebrations

The high court said that religious festivals are required to be celebrated and no community can be prevented from following its practices

The Madras High Court on Friday allowed individuals install Ganesha idols outside their homes and immerse the idol in water bodies individually while following the COVID-19 guidelines.

A division bench of the high court while disposing the plea said that the individuals celebrating Vinayaka Chaturthi should adhere to the coronavirus guidelines. The court also made it clear that groups or organisaitons would not be allowed to conduct any celebrations as well as processions on the occasion, said a report in The New Indian Express.

The two-member bench of justices MM Sundresh and R Hemalatha said that religious festivals are required to be celebrated and no community can be prevented from following its practices.

The high court order came after several petitions challenged the state government order prohibiting people from installing idols in public places and processions.

G Karthikeyan earlier submitted that the Hindu Munnani would not conduct any processions as part of the festival and would cooperate with the authorities abiding by the orders.

The Shiv Sena also agreed to cooperate with the government during the festivities.

The state advocate-general Vijay Narayan contended that relaxations cannot be provided as allowing this will result in things going out of hand creating law and order issues.

The state government passed an order keeping in view the rising cases in the state and it would be difficult to control the crowd during the festivals, Narayan said.

It may be recalled that a war of words has been going on between the BJP and the ruling AIADMK in the state for the past few days over the issue of idol immersion during the Ganesha festivals.

The state BJP leadership had met with Chief Minister Edappadi Palaniswami requesting relaxations on the occasion a couple of days ago. The CM had rejected the demand of the BJP leaders.
